The following terms & conditions apply to any shopping done on the Trikart website and are drawn keeping in mind the best of both the parties. It abides with the law and does not hamper with your rights as a consumer. Trikart Kuwait can be referred to as “Trikart”,“us” or “we”. By using the website or registering on the site, you have agreed to the terms & conditions and our cookies and privacy policies.

  1. The basis of using the Trikart Website

1.1 The Trikart Kuwait website is free of charge and can be used for your personal use keeping in mind the privacy policy and terms & conditions. By using the website you have agreed to our privacy policy and terms & conditions as listed below.

1.2 The Terms and Conditions talk about the use of the Trikart website in general and about all our services and the products that you can shop on our website.

2. REGISTRATION

2.1 You must be over the age of eighteen to register on the website of Trikart Kuwait.
2.2 The personal information provided by you at the time of registration must be accurate, true and complete.

3. AMENDMENTS

The terms & conditions can be revised at any given time. It is best advised that you visit this page periodically to see the changes made as you are liable to these terms whenever you make a purchase on the Trikart website.

3. PASSWORD AND SECURITY

3.1 As you register to use Trikart for your online shopping, you will be asked to create an account using a password. The password should be confidential and it should not be shared with anyone. Trikart Kuwait does not take any responsibility for the activities that may happen on your account after the submission of your password. If you feel like there is someone else is using your account, kindly notify the customer care immediately.

3.2 If Trikart observes any activities that may be a breach of security or misuse of the website then
we may request you to change your password or your account may be suspended as per the terms
and conditions listed below.

 

4. INTELLECTUAL PROPERTY

4.1 All the content on the Trikart website is protected by copyright and trademark and other intellectual property rights. No one can reproduce, modify, distribute, copy or use the protected content as theirs without the consent of Trikart Kuwait. You may retrieve and save information for your personal use or reference, but breach of intellectual property rights and use of protected content for commercial use is subject to legal action.
4.2 Trikart Kuwait does not grant any licence in these Terms and Conditions to use any of our trademark information either online or offline or its affiliated companies.

5. LIMITATIONS

5.1 You cannot use the Trikart website for the purposes listed below:

 

  • To gain unauthorised access to other computer systems
  • To Interfere with any other customers’ use of the Trikart website.
  • To interfere or disrupt networks or websites connected to the Trikart Kuwait’s site.
  • To make, transmit or store electronic copies of material that is protected by copyright without the consent of the owner.
  • To transmit material that contains any promotional material about good or services to spam or junk
  • To impersonate another individual
  • To refer to other website addresses outside of the Trikart Kuwait website.
  • Advertising

5.2 Trikart Kuwait reserves the right to add, remove or to change the content posted on the website. You cannot repost material that Trikart has removed or refuses to post on the website.
5.3 You are liable for all the losses, costs and expenses incurred by Trikart and all damages awarded against us by a court and any amount paid by us owing to any settlement arising due to or in connection with:

  • Claims made by any third parties citing that the use of Trikart Kuwait by you is offensive, abusive or defamatory, illegal , obscene or pornographic in nature based on the applicable laws and regulations.
  • If any third party claims that the use of Trikart infringes on their rights or intellectual rights of any nature.

5.4 By submitting the material you are giving Trikart Kuwait a perpetual, non- exclusive and royalty free license to modify, translate, make available, reproduce, translate, distribute and sublicense the material in whole or part.

 

6. USE OF COMMUNITY SITES

6.1 The website of Trikart includes a lot of community sites which allow users to interact using messaging boards or discussion forums
6.2 It is advised that no individual posts their personal details on the community sites.
6.3 Trikart does not control or moderate the content on the community sites. However, if Trikart Kuwait feels any content is unsuitable, we may refuse to post the content or remove it if it affects the reputation of the website or the comfort of fellow users. Trikart may review or edit the community sites.

6.4 Trikart Kuwait does not take any responsibility for the opinions, reviews or advice offered on message boards by different individuals. The person posting the content is solely responsible for their communications on the community sites.

 

7. THIRD PARTY WEBSITES

Sometimes Trikart Kuwait may include links to other websites or material for the ease of the customers. We do not take any responsibility for the content of these websites.

 

8. ADVERTISING AND SPONSORSHIP

Parts of the website may contain advertisements and sponsorship ads. The third party advertisers must ensure that the content submitted is in line with the rules laid by the website. We are not responsible for any misinformation or inaccurate advertising as provided by the third parties.

 

9. AVAILABILITY OF THE TRIKART KUWAIT WEBSITE


9.1 We at Trikart strive to offer an easy and hassle free shopping experience. Thus, you can access our website whenever you wish. However, due to any errors if the website does not work, we request you to reach out to our customer care.
9.2 In case the website is undergoing some maintenance, repair or updates of any new features, it may be restricted to use for a short period of time.
9.3. Every purchase you make on Trikart Kuwait comes with its specific terms & conditions. If you have any doubts or queries, kindly reach our customer care to assist you with your concerns.

 

10. DETAILS AND PRICES OF PRODUCTS


10.1 Every product comes with precise description using simple language, quality images and videos wherever possible. The real product may vary slightly from what is shown on the website as the images are used for representation purpose only. The information provided based on the technical functions and finer print is provided by the manufacturers and Trikart has no role to play in it. However, if you still have any doubts, you can reach our customer care for assistance. The product description or information can be changed by Trikart Kuwait without further notice.
10.2 Sometimes, the prices may differ online as compared to the offline Trikart stores. The prices online are applicable for online purchase and we are not obligated to honour the price in store.
10.3 If by any error, a product is underpriced, we are not liable to sell it at the stated price. The corrected price will be notified to you and you can choose to order the product if you wish to. If you wish to not pursue the product, the paid amount will be refunded to you as per the refund policy.
10.4 If you have placed an order and paid via debit card and wish to cancel the order before it is dispatched, the full amount will be reimbursed to you via the same mode of payment and no cash reimbursement will be made under any circumstances.
10.5 The price of a product mentioned on the Trikart website does not include the delivery charges that will be levied on the bill during the checkout.

 

11. AVAILABILITY OF PRODUCTS


11.1 All products showcased on the website are subject to availability of the stock.
11.2 We always ensure to have a steady flow of stock, and if the product is out of stock, the same will be notified to the customer. We are not liable to restock the product if it’s availability is beyond our control.
11.3 We may discourage bulk buying of some products in order to offer a fair chance to all our customers. A certain limit on the number of products can be set by Trikart and it is applicable to orders made from one account, to one address or from one debit card. If there is a limit set on the purchase of the product, the same will be shown on the website while you make a purchase.

 

12. ACCEPTANCE OF YOUR ORDER


12.1 Once your order is confirmed, a confirmation email is sent to you with all the details of your purchase.
12.2 There is no other communication from our end other than a confirmation sent to you acknowledging your order. At this point, a contract is drawn between us, where we sell to you, and you buy from us.
12.3 Once the order is placed, amends cannot be made (read more about how you can cancel an order in paragraph 15 listed below).
12.4 If at any point, we decline to ship your order, and you have already paid for it, then the full refund will be made to you as per our refund policy.

 

13. DELIVERY OF YOUR ORDER


13.1 The delivery will be made to the address as provided by you. When the delivery agent arrives to deliver your goods, you must provide an ID proof in the form of an original labour card, passport, driving license, Emirates ID, Free zone ID to support consignee verification.
13.2 Trikart Kuwait does not offer international shipping.
13.3 Our delivery agent delivers the order within 24 hours of placing your order. We do not deliver via suppliers or other agencies.
13.4 While we strive to deliver the order within 24 hours of the order being confirmed, there may be some delays due to some unavoidable circumstances. In such a situation, we will notify you about the delay in the delivery of your product.
13.5 Kindly check the following before ordering the product online:

  • If the item will fit through your doors
  • If the product will be easily accommodated in the space designated for it
  • If there is a clear pathway from the road to your door
  • In case you live in an apartment, kindly check if the lift can accommodate the product.
  • If there are any such challenges, kindly inform us in advance.
  • Kindly make sure that your door is easily accessible on the day of delivery.
  • Kindly ensure that delicate pieces are put away while a product is assembled.
  • The floor must be covered to prevent any scuffing.

 

14. CANCELATION OF YOUR ORDER

14.1 If you wish to cancel your order, Trikart Kuwait will cancel your order, however, the transaction charges will not be refunded. If the order is shipped, the delivery and reverse pickup charges will also be levied.
14.2 You can reach our customer care to cancel the order.

 

15. DELIVERY OF FAULTY PRODUCTS

If you have received a damaged or faulty product, you can return it and seek a refund. If you wish to get a replacement of the same, the request can be made to the customer care. You can read more about our return & refund policy here (CTA to the return & refund page)

 

16. REFUNDS

If you wish to return a product and want a refund, the same will be made to you based on the following criteria:
16.1 If Trikart is unable to deliver a product within a stipulated period of time.
16.2 If the product is not working properly once delivered.
16.3 If the product is lost in the process of being delivered.
16.4 If the product is beyond repair.
16.5 The refunds on any products that have a promotional offer will be based on the terms of the offer.
16.6 The refund, when made online will be shown only in the next billing cycle from the date of application of refund.
16.7 If the entire order is returned, then Trikart Kuwait will refund the entire delivery charges. If a part of the order is retained, relative delivery charges will be retained by Trikart.
16.8 In order to exchange, return or seek a refund, the product should be intact with all its packaging, accessories, manuals etc. The receipt of the order should also be retained as well. If any of the products are missing, and the product details are tampered with, the return process will not be encouraged.
16.9 You can seek a money back guarantee within 7 days if you change your mind. However, the product must be intact and all the accessories, manuals, cables or any additional products that accompanied the product must be retained. The original packaging, product code and the receipt must also be retained. Any transaction charges, delivery and reverse pick up charges as applicable will be retained in case of refund.

 

17. REFUNDS

The following return & exchange policies are applicable to the offline store and online store as well.
17.1 EXCHANGE AND RETURN
Exchange and return is only applicable to the following sections in this department:

  • Mobile phones
  • Home appliances
  • Other electronics

   17.1.1 You can exchange goods within 7 days or purchase and the different products can be purchased amounting to the same value. The packaging and invoice should be retained in order to exchange.
   17.1.2 The product should be unused and the receipt should be retained. A credit note may be issued on request of the customers.
   17.1.3 Any credit notes or exchange voucher, the same must be authenticated by the signature of the manager on duty after verifying the serial number of the product.
   17.1.4 If the product purchased is past its expiry date.
   17.1.5 If a product is defective or faulty and the same is verified by an expert, we will first try to repair it. If the product cannot be repaired, then the same amount will be refunded or a credit note will be provided.
   17.1.6 If a product cannot be repaired, an exchange voucher will be issued. The store manager reserves the right and his decision will be final based on the inspection of the product.
   17.1.7 If the customer wishes to return a product that is spoilt or is not of satisfactory quality, then the store personnel along with the consent of the manager can initiate the process of exchange return or refund.
17.2 EXCLUSION FROM EXCHANGE/RETURN:
   17.2.1 Owing to concerns of hygiene and personal wellbeing, products like lingerie, cosmetics, perfumes etc along with personal grooming products like trimmers, epilators etc will not be exchanged once used.
   17.2.2 There is no refund, return or exchange of perishable items
   17.2.3 If the customer has accidentally purchased the wrong product and wishes to return it immediately after the purchase, an exchange note may be permitted based on the consent of the store manager.
   17.2.4 If you have purchased an item that is already expired at the time of purchase qualifies for exchange.
   17.2.5 If the product is of a poor quality and same day return is initiated along with the original bill, an exchange note could be issued.
   17.2.6 If the customer insists on return then based on the consent of the in-house supervisor
   17.2.7 If any item is spoilt, it should not be mixed with the other items.
   17.2.8 Offering an exchange voucher, credit note and refund is the last option sought to retain the customer and prevent any unpleasantries.
   17.2.9 Any exchange voucher or credit notes is valid only with the signature of the manager on duty.
17.3 EXCHANGE/RETURNS POLICY
   A. Sections in the department:

  • IT products
  • Electronics / Home Appliances
  • Accessories
  • Toys and sports
  • Telecom (recharge coupons and SIM cards)

Exchange/Return procedures:
   17.3.1 Products that are unused and come with original invoice, correct serial number, packaging and all the accessories can be returned within 7 days for items of the same value.
   17.3.2 Products should not be used, washed, altered or soiled and should be in saleable condition.
   17.3.3 Products should be fit for resale.
   17.3.4 If a product is ordered and billed but not delivered is eligible for exchange, refund or return.
   17.3.5 On the delivery of the product, the customer opens a product that is damaged, it is subject to exchange, refund or return.
   17.3.6 Any products that are to be exchanged, returned or refunded with a credit note, the same should be recognised with the signature of the manager on duty.
   17.3.7 If the delivered product does not last for a reasonable amount of time or the complaint is raised within a reasonable amount of time to the help desk, it could be eligible for return, refund or exchange.
   17.3.8 If an incorrect item is purchased or sold by the Trikart staff.
   17.3.9 The product is eligible for return, exchange or refund if it has a manufacturing defect in case of textiles, luggage etc.
   17.3.10 If a gadget or electronic item has any manufacturing defect or does not function properly the same will be sent for repair.
   17.3.11 If the product is beyond repair, then a refund or exchange is permitted amounting to the same value.
   17.3.12 If the product is not repairable or exchanged, an exchange voucher or credit note may be issued by the store manager. He reserves the right to take the final decision about the same.
   17.3.13 A refund is allowed only with the consent of the store management on duty.
   17.3.14 Products like appliances, electronics etc come with after sales service and the same can be redeemed at authorised service centres under the terms & conditions of their warranty.
   EXCLUSION FROM EXCHANGE/RETURN:
   17.3.15 Only mobile phones and their accessories come with a service warranty.
   17.3.16 The exchange or return is only applicable within the warranty period for mobiles. If the device is not damaged through misuse, it will be sent for repair to the authorised personnel.
   17.3.17 It is mandatory to take the advice of the stall from the mobile phones section and from the after sales counter in case of exchange or return of the product.
   17.3.18 The final decision about the exchange voucher or credit note is at the discretion of the store manager. Any refund will be done based on the approval of the store management and will be the last resort to prevent any disagreements or disputes.
   17.3.19 With the concern for hygiene, products like lingerie, swimwear, jewelry, cosmetics or personal grooming products like trimmers, epilators etc once used will not be allowed to return, exchange or refund.
   17.3.20 If the product is damaged while in use, it does not qualify for repair, exchange or refund.
   17.3.21 There is no exchange or return on books, magazines, CDs, office software’s, DVDs once they are purchased and taken out of the store.
   17.3.22 If the garments are altered they are not eligible for return, exchange or refund.
17.4 ISSUE OF EXCHANGE VOUCHER / CREDIT NOTE
   17.4.1 An exchange voucher or credit note is time bound and the original receipt must be produced at the time of purchase via the voucher.
   17.4.2 If the product is spoilt or damaged within the warranty period and is cannot be serviced.
   17.4.3 When the product does not meet the customer’s expectations or requirements and the customer wishes to return the product with the original content, packing and receipt.
17.5 PROCEDURE FOR THE ISSUE OF EXCHANGE VOUCHER OR CREDIT NOTE
   17.5.1 The customer must produce the original bill at the help desk.
   17.5.2 Under normal circumstances, an exchange voucher or credit note will be provided with the approval of the section Supervisor and the Manager on duty. If the product is returned after seven (7) days, the General Manager will take the final decision.

  • Under certain circumstances, if the manager on duty is not reachable and the section staff member agrees to take back the item, then an exchange voucher or credit note could be issued to the customer provided the staff informs the General Manager. The immediate next Duty Manager must verify the exchange deposit and must physically verify the product along with the Section Supervisor

   It is compulsory to fill the following details on the Customer Credit Note:
      1. Customer’s Name & Mobile number
      2. Name and Signature of the concerned section staff/Section Supervisor, Customer Service Manager and Manager on duty

  • Any approvals for the credit note must be done immediately after verifying the product in the presence of the customer and verifying the same.
  • A copy of the credit note must be retained by the help desk and the same must be handed over to the cash office at the end of the day.The Accountant present at Cash Office must verify that all Customer Tax Credit Notes received are approved by all three (3) approvers.

   17.5.3 The exchange voucher / credit note is time bound and must be used within the stipulated period of time at the same store where it was issued. The customer relations supervisor should select the item from the bill and put a tick on the item to be returned. The barcode on the receipt will be scanned or details will be taken manually. The store number, POS number and receipt number will be entered into the POS machine. The products to be returned or exchanged will be selected and the correlating amount will be deduced. Thus a credit note will be generated. No refund will be provided for the voucher or credit note. The note must be signed by the supervisor and the name of the individual who has approved it must be mentioned.

 

18. PAYMENTS

18.1 The payment for your product will be taken when the order is placed . Payments are done via a professional third-party cyber source payment gateway.
18.2 Your debit card details will be encrypted & safeguarded to the highest standard and held on a Cyber source host payment gateway ensuring that it is safe from hackers.
18.3 When you shop online on Trikart Kuwait’s website, we only accept orders from a web browser that communicates through the Secure Socket Lawyer (SSL) technology. For instance, you can use a 7.0 version or higher version of Internet Explorer, version 3.5 or higher of Firefox, Chrome version 10 or higher and Safari version 5 or higher. One cannot place an order through unsecured connection.
18.4 The customer will be charged as per the local currency and if any international card is used, the difference will be as per the charges of the bank or card company.

 

19. FREEBIES AND PROMOTIONAL OFFERS

19.1 If you wish to return a product, and if it has any offers or promotions attached to it, the entire package must be returned. If you do not wish to return the free item, a certain amount will be charged for the same.

 

20. AMENDMENTS

These Terms & Conditions may be updated periodically and the same will be notified via email to the email id provided during registration. Or an announcement about the same will be made on the Trikart website. If you have any issues with the updated terms & conditions you may choose to not shop from the website. However, once you do continue to shop from the Trikart Kuwait website, it indicates that you adhere to the updated terms & conditions.

 

21. CLOSURE OR SUSPENSION OF YOUR ACCOUNT

21.1 Trikart Kuwait may suspend or close your account at our reasonable discretion if you violate any of these Terms and Conditions. You will not have access to the website to shop on the website as
your account will be closed or suspended.

 

22. OUR RESPONSIBILITY TO OUR CUSTOMERS

22.1 The Trikart Kuwait website is an entity of Trikart Kuwait and comes with no warranty or guarantees.
22.2 The Trikart Kuwait may provide content from other websites for the benefit of the customers and we strive to ensure that the content is accurate and comes from a recognised source. However, Trikart is not responsible for any errors and omissions or any technical problems. If we are informed about any errors, the same will be rectified to the best of our capacity.
22.3 We disclaim all liabilities in connection with the following:

  • If the Trikart website or app is incompatible with your devices or browser
  • Any technical errors or interruptions that you may encounter while using the Trikart website

22.4 If we breach any of these Terms and Conditions, we are only responsible for the losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time of placing the order on our website.
22.5 We only sell products for personal use hence any business losses or loss of data that you may incur is not a liability of Trikart.

 

23. MISCELLANEOUS

23.1 As a consumer you cannot transfer your rights under these terms & conditions to anyone else. However, we may transfer our rights under these terms & conditions to a business who can uphold your rights.
23.2 If you violate any of these Terms and Conditions and we choose to ignore it at that point, we will reserve rights to take an action at a later date or in any other situation if you continue to violate the terms & conditions.
23.3 Neither yourself nor we, at Trikart Kuwait shall be responsible for any violation of these Terms and Conditions in circumstances beyond our control.
23.4 Except under the guidance of the terms & conditions, your personal details are secure as per our privacy and cookies policy.

25. STANDARD TERMS & CONDITION FOR THE USAGE OF E-COUPONS

25.1 Usage of E-Coupons

  • E-Coupons by Trikart Kuwait can only be used on the Trikart website and is not redeemable on any other platforms associated or owned by Trikart.
  • An E-Coupon is redeemed after entering its code at the appropriate point during the checkout process. Proof of entitlement may be needed to redeem the coupon.
  • When you use the E-Coupon, it indicates that you are in agreement with the E-Coupon Terms and Conditions.
  • Trikart Kuwait reserves the right to cancel an E-Coupon for any reason at any given time.

25.2 Distribution of E-Coupons

  • E-Coupons will always, under all circumstances remain the property of Trikart Kuwait.
  • The E-Coupon cannot be copied, reproduced, distributed, or published directly or indirectly in any form or means for use by any other individual apart from the original recipient.
  • E-Coupons that are distributed or circulated without the written consent of Trikart Kuwait are not valid and may be refused or cancelled.

25.3 Permitted use of E-Coupons

  • Each E-Coupon will be valid for use by a recipient only once.
  • Only one E-Coupon is valid for use for one customer and one household as the case may be.
  • An E-Coupon cannot be tied up with any other offers.
  • The e-coupons provided cannot be exchanged for cash or to purchase gift vouchers.

25.4 Excluded goods and services

  • Some products or services cannot be availed using the E-coupon. The list of services or products that are excluded from the application of E-coupon will be updated and the same will be notified along with the E-coupon or on the website.
  • E-Coupons may be limited to redemption in respect of certain products or services or certain products or services may be excluded from the ambit of use of the E-Coupon, in which case notice will be given to you at the time of issue of the E-Coupon.
  • Excluded goods and services will not benefit from any promotional discount.

25.5 Minimum spend requirements

  • If an E-coupon has to be redeemed a minimum amount is required to be spent in order to qualify to use the coupon. The same will be notified with the coupon and charges like delivery charges or additional transaction charges will not be included in the minimum spending requirement.

25.6 Calculation of discount

  • The said percentage discount will be given on a purchase and the cost of the qualifying purchase will be deducted by the stated discount percentage.
  • Additional charges like delivery charges shall not be included in the discount unless specifically stated.

25.7 Security and Fraud

  • When you use an E-Coupon, it is an indication that you are the authorised recipient of the coupon.
  • If we detect that the Ex-coupon has been used unlawfully then we may reject or cancel the discount and you will have no claim against us in such a situation.
  • If the E-coupon is rejected for any reason, the same will be notified to you and the updated
    amount will be conveyed to you to give you a fair opportunity to cancel the order if you wish
    to.

25.8 Limitation of liability

  • The process of ordering with the E-coupon is the same as placing an order under normal circumstances.
  • If for any reason the coupon does not get through, is canceled or ultimately results in the inability to use it for any reason, Trikart Kuwait is not liable for the same.

25.9 Variation

We reserve the right to change or terminate any E-Coupon at any time without notice.
